Terms of Service

Binding version: German.

Version 1.1 · As of 2026-10-26

§1 Scope & contracting party

These terms apply to all users of Hospitly International (operated by Enrico Kaldasch). The contracting party of the users is Enrico Kaldasch & Pornvilai Kaldasch GbR, Ackerstraße 19, 04910 Elsterwerda, Germany. The platform is a job board / placement service — not an employer and not a staffing agency.

§2 Test phase (beta)

The platform is in an open test phase (beta). Availability, features and content may change; uninterrupted or error-free use is not guaranteed in this phase.

§3 Services, fees & role

Use is free for candidates; candidates never pay any fee and generally act as consumers. Employers pay for listings/visibility and act as businesses (§ 14 BGB); billing is by invoice. Prices are shown transparently incl. statutory VAT before booking.

§4 Accuracy & verification

All information must be accurate; false information may lead to suspension. We check employers and listings before they go live on a best-effort basis and to the extent possible in the respective country (incl. licence, business, contacts). The scope and depth of these checks vary internationally and are limited; they are not a guarantee of accuracy, legitimacy or solvency. Liability for information provided by third parties is excluded — users must still exercise their own due diligence. The liability provision in § 6 remains unaffected.

§5 Platform obligations (P2B/DSA)

As an online intermediation service, the P2B Regulation (EU) 2019/1150 and basic Digital Services Act duties (notice-and-action) may apply. A reporting channel for unlawful content is available (scam report per listing). Listings are ranked by the criteria selected by the user (recency or salary); paid prioritisation only occurs where a premium feature is expressly marked as such.

§6 Liability

Hospitly provides only the technical platform and is not a party to agreements between candidates and employers. There is no blanket exclusion of liability towards consumers; liability for intent, gross negligence, breach of cardinal obligations and for damage to life, body and health remains unaffected. Otherwise liability is limited to foreseeable, contract-typical damages.

§7 Account & deletion

You can delete your account yourself at any time — in the logged-in area “My area” via “Delete account”. Your personal data (profile, applications, saved jobs) will be removed; invoice-relevant data is retained pursuant to § 147 AO for up to 10 years (see privacy policy).

§8 Governing law

German law applies. Mandatory market-specific provisions of the respective target countries remain unaffected. If you are a consumer, the mandatory protective provisions of the law of your habitual residence remain unaffected (Art. 6(2) Rome I Regulation).
